1. Introduction

Welcome to our website. We are an ethical business and we want you to be completely happy with every item purchased from us and with every transaction that we process on your behalf. We have constructed our business to keep things as simple and straightforward as we can whilst protecting your rights as our customer and our rights as a small, independent business.

Please read carefully the information below to ensure you are aware of, and agree to comply with, these terms and conditions which, together with our Privacy Policy, govern The Ethical Food Clubs’s relationship with you with respect to this website. If you disagree with any part of these Terms and Conditions, please do not use our website.

The term ‘The Ethical Food Club’ or ‘us’ or ‘we’ refers to the owner of the website whose principal place of business is 33 George Raymond Road, Eastleigh, Hampshire SO50 5SZ. The term ‘you’ refers to the user or viewer of our website. “The agreement” means these Terms and Conditions together with any contract in which they may be incorporated by reference or otherwise. “Goods” refers to all items ordered from The Ethical Food Club via the website and “the website” refers to the website at www.ethicalfood.club.

2. Changes to these Terms and Conditions

We reserve the right to change these Terms and Conditions at any time and the revised Terms and Conditions will be published on the website. Please ensure you check the Terms and Conditions regularly as your use of the website will be subject to the Terms and Conditions published on the website on the date of access to the website. Your use of the website following the publishing of any changes to these Terms and Conditions will indicate your agreement to the revised Terms and Conditions.

3. Privacy Policy and Cookies

Our Privacy Policy sets out how we process and use any personal data that we collect from you or that you provide to us. By using the website you are giving your consent to such processing and you warrant that all information provided by you is accurate. We may occasionally restrict your access to the website to allow for repairs, maintenance or improvements to the website. Please report faults, errors or omissions to us and we will make the necessary corrections as soon as we reasonable can.

You shall not breach or attempt to breach the security of the website and you shall not use the website in any way that may cause the website to be damaged or impaired.

A breach of the Acceptable Use of the website as set out in these the Terms and Conditions may be a criminal offence and/or may give rise to a claim against you for damages.

The website is intended for residents of the United Kingdom and we make no claim that any content on the website is appropriate or available for use in locations outside the United Kingdom. If you access the website from other locations you do so at your own risk and are responsible for compliance with any and all local laws, if and to the extent local laws are applicable.

You will be responsible for securing your computer systems when using the website and we will not be responsible for any loss suffered as a result of your failure to do so.

We will not be liable for any loss or damage caused by a computer virus or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the website or to your downloading of any content on it, or on any website linked to it.

This website is for domestic and private use. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity when using this website.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. All rights are reserved.

You may print and/or download extracts, of any page(s) from the website for your personal use and for you to draw the attention of others to content published on the website. In such cases you must acknowledge us (and that of any identified contributors) as the authors of the content. Unauthorised use of trademarks, service marks, graphics and logos used on the website is strictly prohibited.

8. Your Information

Any collection and use of your personal data will be in accordance with the EU General Data Protection Regulations and our Privacy Policy.

9. Membership of The Ethical Food Club

The Ethical Food Club offers memberships to individuals aged 18 years and over by way of registering as a Member. We reserve the right to refuse Membership to any applicant and Membership is revocable by us without cause.

Membership is subject to any and all rules adopted by us, and these rules may be amended from time to time without notice.

Memberships are not transferable and cannot be sold or traded.

Should you wish to become a Member of The Ethical Food Club to receive trade pricing and offers you must register for an account and provide certain information during the application process. By joining us as a Member you represent and warrant that:

  1. You are aged 18 or over and able to form a legally binding contract;
  2. You are resident in the United Kingdom;
  3. All registration information that you submit is complete and accurate;
  4. You will maintain the accuracy of all registration information;
  5. You will maintain the confidentiality of your account;
  6. You will immediately notify us of any unauthorised use of your account, or suspected unauthorised use, or any other breach of security;
  7. You will be solely responsible for all activity that occurs under your account.

If you wish to cancel your Membership you may contact us, by email or telephone, to request we change the status of your account which we will act on as soon as we practically can. On completion of this request, when you subsequently visit www.ethicalfood.club, you will not be able to access the member areas of the website.

11. Purchases and Payments

On placing an order on the website, you will receive an automatic email confirmation of the details of the order. This confirmation email represents an offer from you to buy the goods from our wholesaler.

We accept payment via cash, bank transfer or credit/debit card (1.69% fee applies). The prices published on the website are not binding to us and we reserve the right to revise published prices and charges in the event of any change in our costs and/or prevailing conditions between the date of order and the date your order is shipped/collected. All prices shown are inclusive of value added tax where applicable, which will be charged at the current rate.

We endeavour to keep the stock level information for products on our website as accurate as possible, but we cannot guarantee that we will always be able to supply all the goods contained in your order. If, for any reason, we are unable to supply an item, we will not be liable to you except to ensure that you are not charged for that item or, if you have already been charged and subsequently we are unable to supply the item, we will refund you – see point 13. We reserve the right to withdraw any item from sale at any time and for any reason.

Once your order is packed and ready for despatch, you will be notified by email.

12 Community Pot

You will be required to pay a compulsory donation for the service on orders totalling £10 or more. The donation is calculated at 5% of your order amount.

13 Refunds 

Refunds for out of stock items or price differences on substituted items will be returned to you in the form of store credit to be used against future orders. Store credit can be accessed and applied through the My Account section under ‘Coupons’ and on the Trolley and Checkout pages. If you require the funds to be returned to your bank account or card, contact orders@ethicalfood.club to arrange. 

14 Returns

Should you be dissatisfied with any goods you receive from us, please contact us using the details provided on the Contact page. Due to the model of the food club, we are unable to accept returns but we will endeavour to find a new buyer for the product through the network of members and by utilising The Ethical Food Club Facebook Group.

15 Perishable Foods

If you order fresh or chilled products from us, you acknowledge that there is a possibility the goods may be delayed in transit and/or may travel in conditions where they are not stored as recommended by the manufacturer. You agree that you, or the person receiving the goods, will transfer all perishable items to a refrigerator immediately upon receipt.

16 Defective Goods

You are requested to examine all goods upon collection.

In the event of any item being defective in materials or workmanship we undertake to replace the item free of charge. We are to be allowed a reasonable time to enable us to replace any defective item, providing that the item is returned to us in the state in which it was supplied by us. Our liability is limited to such replacement, which shall be deemed a complete fulfilment of our contract. If it is not possible to replace the item, for whatever reason, we shall issue a refund for the defective item.

We shall be under no liability whatsoever for any consequential damage, loss or other expenses whether arising out of contract, negligence or otherwise.  We shall be under no liability for defective parts damaged in transit whether due to unsatisfactory packaging or otherwise.

No compensation will be given for any glass damages.

17 Retention of Title

Property, legal and beneficial in any goods supplied by us shall pass to the you only when we have received full payment for all sums then owed by you to us. Risk shall pass to you with possession of the goods.

18 Our Liability

The products that we supply are provided by third parties and we may provide links to certain third party websites. We are not responsible for the content of any such third party products or websites and we do not accept any liability or responsibility for any third party products, materials or websites, or for any other materials, products or services of third parties and you access such websites at your own risk.

19 Product Information and Images

Product details on The Ethical Food Club website have been prepared for information purposes only. We believe they are accurate but please do not use the information as a substitute for reading the product packaging and label prior to use. Products and their ingredients are frequently subject to change and if you require precise ingredient information you should consult the manufacturer, whose contact details will appear on the packaging or label. The Eco Collective is therefore unable to accept liability for any incorrect product information.

Whilst we have taken every care to use accurate product images, packaging is subject to change by the manufacturer and images may therefore differ to the product received. Any images which show serving or usage suggestions and which include additional items and/or ingredients pictured with the product you are purchasing are not included.

No product for sale through this website should include any ingredient derived from an animal, nor should any product have been tested on any animal. If any product listed for sale on this website contains animal derived ingredients, or is found to have been tested on animals, it has either been included in error or the manufacturer has changed the ingredients or formula since the product was originally listed. Such products will be removed from sale immediately that we become aware of them. We value your help and feedback so please do let us know if you find any product to be inaccurately listed.

The recommended retail prices listed on our website are those provided by the product manufacturer and they may not represent the prevailing price in every area on any particular day.

20 No Waiver

Our failure to insist upon strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right.

21 Indemnity by You

You will be liable for any loss or liability arising from or in relation to any breach by you of these Terms and Conditions or of any applicable laws and accordingly agree to indemnify The Eco Collective for any such loss or liability.

22 Governing Law and Jurisdiction

This agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with English law. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of this agreement.
